Snap Web Design Terms and Conditions

These Terms and Conditions set forth the provisions under which the Client may use the services supplied and is a legal agreement between Snap Web Design and their Client. The contract between Snap Web Design and the Client will be on these conditions, to the exclusion of all other terms and conditions. Any variations to these conditions shall have no effect unless agreed in writing prior to the commencement of any work.

GENERAL
Snap Web Design will carry out work only where an agreement is provided either by email, telephone or post.
Snap Web Design will carry out work only for clients who are 18 years of age or above.

DEFINITIONS:
  • Project: Any work undertaken or service provided by Snap Web Design for the Client at their request and as described in our confirmation order email to that Client.
  • Order: A written or verbal contract between Snap Web Design and the Client, this includes telephone and email agreements.
  • Designer: Snap Web Design, it's partners and associates.
  • Client: A person, persons, business or organisation using any of the services provided by Snap Web Design.
  • Live Mode: The date the website is available on the Clients chosen domain.
  • Domain: The website address as specified by the Client.
  • Open Source Software: Software made freely available to anyone under the GNU General Public License (GPL).
  • Hosting: A yearly cost to keep a clients website activated online.
  • Content: Text and images that the Client provides and requires on the website.

THE 15 STEP PROCESS:
  • The Client contacts Snap Web Design to request their service by email, telephone or post.
  • Snap Web Design responds with a questionnaire sent by email or post to establish the services required by the Client.
  • When the questionnaire has been returned to Snap Web Design a quotation will be calculated and sent to the Client by email or post. Quotations are valid for 28 days from the date of issue.
  • The Client accepts the quotation by paying a deposit of 40% of the quoted amount by Cash, Cheque or online payment through PayPal. All cheques are to be made payable to Graham Jennings. If you choose to pay by PayPal we will send you an electronic invoice by email.
  • When the deposit has cleared in our bank account the Designer will commence work on the initial design of the Clients website.
  • The design will be made available to the Client for their approval of layout, colour scheme and design.
  • The Client requests minor alterations if necessary, or approves the design.
  • If minor alterations are requested steps 6 and 7 will be repeated, after making the requested alterations. This can be done twice without incurring further costs.
  • If major alterations are requested Snap Web Design reserve the right to issue a quotation and invoice to accommodate these changes. This will need to be paid in full before the alterations are made. Steps 8 and 9 will then be repeated.
  • Once the design is approved a further payment of 30% of the original quotation will be required from the Client before work is continued.
  • The Client will provide all content for their website, including pictures and text, to be included on their website.
  • Changes made after the design is approved will incur further costs which will need to be paid in full before work continues.
  • When the design work is completed the website will be made available at a temporary online location for the Clients approval for a period of no longer than 5 days.
  • The Client approves the design by sending the remaining balance to Snap Web Design.
  • When the final payment has cleared in our account Snap Web Design will make the website available on the Clients domain, and will send a completed version of the website, either by email or on disc, to the client.

MINOR ALTERATIONS CONSIST OF:
  • Re-ordering the internal links in the main menu of the Clients website.
  • Changing the overall size and/or colour of the main text.
  • Changing the position of any image to within 10% of their original position (based on the size of the image).
  • Changing the position of the main menu to within 10% of it's original position (based on the size of the menu block).
  • Changing the colour of the main background of you website.
All other alterations are considered major, and will incur further charges based on our hourly rate.

TERMS AND CONDITIONS - FULL:
  • The works to be carried out shall be as set out in the Snap Web Design confirmation order email.
  • Email will be the method of contact with regard to all communication. Although Snap Web Design can be contacted by telephone, we will use email as our method of communication and therefore it is the Client's responsibility to inform us of any change in email address so we always have up to date email contact details. Snap Web Design can not be held liable in any way relating to communication issues if we are not supplied a valid email address.
  • Snap Web Design will only commence work on a Project after receipt of a non refundable, 40% deposit of the quoted Project fee from the Client. Snap Web Design will also require 30% payment on approval of the overall design concept. The final 30% payment is to be made on completion of the website. The website will be switched to Live Mode once the Clients remaining balance is paid in full and has cleared in our account.
  • The deposit paid to Snap Web Design covers the cost of design work carried out as well as any administrative work and communication with Snap Web Design. The deposit is non refundable. Snap Web Design reserve the right to decide whether a refund is applicable if requested by the Client for any reason.
  • Snap Web Design shall expect the Client to carry out sufficient research before proceeding with a website. This will include checking that the website/idea/business will operate legally. It is important that the website is not in any way illegal.
  • It is important for the Client to keep in contact with Snap Web Design throughout the entire Project. If a Client does not make contact for 2 weeks Snap Web Design will make up to 3 attempts to contact the client by email and a further 2 attempts by phone. In Snap Web Design have to contact the Client to obtain content for the Clients website the Client will incur further costs of £5 per email sent and a minimum cost of £10 per phone call made (based on our hourly rate) in addition to our original quotation. If we do not receive a response to these attempts of contact the Project will be suspended and may be terminated. If this oocurs any payments already made will not be refunded. Snap Web Design reserves the right to bill the Client for any work completed that has not yet been billed if a project is suspended or terminated. If a project is suspended or terminated and then re-instated at the clients request further costs will be incurred which will have to be paid in full before work re-commences. Any terminated project will be deleted from our systems 12 weeks after the termination date. The Client will be informed of the termination date by email.
  • Where images used on the website have been purchased by Snap Web Design on behalf of the Client, these images are strictly for use on the Clients website only. Snap Web Design are not liable for misuse of these images by the Client or any other person's copying, altering or distributing the images to individuals or other organisations.
  • Snap Web Design will arrange hosting of the website if the Client requires us to do so and on receipt of full payment of our Hosting fees. In doing so, Snap Web Design will endeavour to provide a reliable and professional service to the Client at all times but do not guarantee that the website Hosting will be available at all times, especially in the event of a technical failure beyond their control.
  • Snap Web Design cannot be held responsible for anything adversely affecting the Client's business operation, sales, or profitability that might be claimed is a result of a service offered by Snap Web Design.
  • Where Snap Web Design provide search engine optimisation for a Client they do not guarantee any specific placement or high ranking on search engines.
  • Snap Web Design will provide the Client with an expected completion date for the Project (live on the internet) if requested. Snap Web Design will endeavour to meet any given deadline, but do not guarantee and are not bound in any way to complete the Project by this date.
  • It is the responsibility of the Client to make sure all content for their website, and information requested by the Designer, is provided in a timely manner. Failure to do so will delay the production of their website and may incur further costs above the original quote which will be payable before work continues. Snap Web Design, or the Designer, can not accept responsibility for any delay caused by this failure.
  • It is the Client's responsibility to check with Snap Web Design whether Open Source Software is being used or not.
  • The Client shall not be charged for any Open Source Software used. If there is a charge for a website using Open Source Software, the Client is paying for the installation and configuration time only. Open Source Software is not owned by Snap Web Design or the Client.
  • Snap Web Design own all design and code of the website until final payment has been received in full. Once final payment is received, the Client will then own the design and code of the website, with the exclusion of any Open Source Software used.
  • All images displayed on the Client's website will only be used after authorisation by the Client, and are the sole responsibility of the Client regarding usage and copyright. Should any legal issues or claims arise from the content or copyright of any images supplied by the Client or Snap Web Design, they will be the sole responsibility of the Client.
  • Domain names will be registered by Snap Web Design if requested by the Client, or if the Client buys a package from Snap Web Design which includes a Domain name within the package offer. Domain names registered by Snap Web Design will be registered to the Snap Web Design current address unless the Client requests otherwise. Although the domain names are registered to Snap Web Design , the Client is the legal owner of the domain and if they request to have details changed or the domain transferred elsewhere, Snap Web Design will do this within a reasonable time frame.
  • It is the responsibility of the Client to renew their domain names when due. If a domain name expires, Snap Web Design can not be held liable for this. If Snap Web Design registered the Domain name as part of a Package, or at the Clients request, Snap Web Design will make reasonable effort to contact the Client regarding domain renewal. Renewal of Domain names transferred away from Snap Web Design becomes the sole responsibility of the Client and Snap Web Design can not be held liable for the failure of the Client to renew such Domain names.
  • Renewal of Hosting is due on a yearly basis. The date of renewal will be annually from the date the website was ordered by the Client. The Hosting will not be renewed if Snap Web Design cannot contact the Client or the Client requests that Snap Web Design no longer host this site. This will also affect the domain as per item 18.
  • The Hosting renewal charge must be received within 10 days of the Hosting expiry date. Snap Web Design reserve the right to deactivate any website where the Hosting has expired and the Client has not paid the renewal charge. There will be an admin fee set by Snap Web Design for reactivating the website/Hosting.
  • If the Client does not use Snap Web Design Hosting services, then the management and Hosting of the Domain name are the full responsibility of the Client.
  • Should a Client wish to move Hosting away from Snap Web Design or transfer a Domain name away from Snap Web Design, a £40 admin charge will be issued, which must be paid before the transfer takes place.
  • Snap Web Design has no control of, or responsibility for, the content of Clients' websites. In no way does the textual or image based Content of our Client's web sites constitute endorsement by Snap Web Design, or approval of the website or the material contained within the website. Snap Web Design has not verified any of the materials, images or information contained within our Client's web sites and is not responsible for the content or performance of these sites or for the Client's transactions with them. Snap Web Design provides links or references to our Client's websites solely for the convenience of prospective customers and intends that the links it provides be current and accurate, but does not guarantee or warrant that such links will point to the intended Client site at all times. We reserve the right to choose whether to link to a Client website or not.
  • Snap Web Design are not liable for loss, damage or corruption to files or information stored on its servers or individual PCs relating to a Client's website. The Client is solely responsible for any information or files relating to its website.
  • If a Domain name is purchased by the Client through a company other than Snap Web Design, the Client has full responsibility in making sure that the domain name is renewed when due. Snap Web Design will not renew the Domain name when annual Hosting renewal is due if the Domain name is purchased through a company other than Snap Web Design.
  • If Hosting is purchased by the Client through a company other than Snap Web Design, the Client has full responsibility in making sure that the Hosting is renewed when due. The Client will also make all login details available to Snap Web Design to facilitate the configuration of the Clients Hosting Server and email accounts and to enable the Client website to enter 'Live Mode' upon its completion, and when all payments have been received.
  • For a period of 30 days after the Client website has entered 'Live Mode' Snap Web Design will correct any errors to the visible content of the Client website free of charge, except where the error lies with the content supplied by the Client. Corrections where it is the fault of the Client will be charged at our hourly rate and will be invoiced to the Client.
  • Cash payments will be considered as received immediately. All other payments methods will be considered cleared when the funds are available in our bank account. Cheques must be made payable to Graham Jennings.
  • Snap Web Design makes no claims that the contents of this website may be lawfully viewed or downloaded outside England and Wales. Access to this website may not be legal by certain persons or in certain countries. If this website is accessed from outside of the United Kingdom, it is done at the visitors own risk and the visitor is responsible for compliance with the relevant laws of the visitor's jurisdiction. The terms and conditions of this website are governed by the laws of England and Wales. Jurisdiction for any claims arising in respect of this website's Content shall lie exclusively with the courts of England. If any provision of these terms and conditions is found to be invalid by any court having competent jurisdiction, the invalidity of of such provision shall not affect the validity of the remaining provisions of these terms and conditions, which shall remain in full force and effect.
  • Snap Web Design reserve the right to modify and update these terms and conditions at any time.
